**You understand that the Website and Services are not a substitute for the in-person treatment or advice of your local dermatologist, primary care physician or any other qualified healthcare professional.

We may make available the ability to (i) communicate with a healthcare provider and (ii) purchase or otherwise obtain certain Products or Services through the Website (collectively referred to as a “Transaction”). If you wish to make a Transaction, you may be asked to supply certain relevant information, such as your credit card number and its expiration date, your billing address, and your shipping information. You represent and warrant that you have the right to use any credit card or other payment information that you submit in connection with a Transaction. By submitting such information, you hereby authorize Company to charge you and grant to us the right to provide such information to third parties for purposes of facilitating Transactions, including Company’s third-party payment processing service. Your medical records may be retained by Company for a period of at least five (5) years, unless a longer or shorter period is required by state or federal law, after which they may be destroyed. If you are younger than twenty-three (23) years of age on the date the records may potentially be destroyed, your records will be kept at least until you reach the age of 23, or as required by state or federal law. Any termination or discontinuance of the Website pursuant to the provisions set forth in this Section shall be subject to compliance with any notice or waiting period provided by applicable law. Location Information. You may be able to adjust the settings of your device so that information about your physical location is not sent to us or third parties by (a) disabling location services within the device settings; or (b) denying certain websites or mobile applications permission to access location information by changing the relevant preferences and permissions in your mobile device or browser settings. Please note that your location may be derived from your WiFi, Bluetooth, and other device settings. See your device settings for more information.
6. Persons Under the Age of 16
Persons under the age of 13 are prohibited from using our Services. Persons between the ages of 13 and 15 may only use our Services with the legal authorization of their parent or legal guardian. Company does not knowingly collect any information from persons under the age of 13 (or from persons between the age of 13 and 15 without appropriate authorization).
Please contact us if you believe we have collected user information about a child without consent from their parent or guardian so we can take corrective action. Requests should include a description of the specific posted information (including information that will allow us to confirm it was created and posted by you) and should be sent to support@skinresearchinstitute.com.
7. Security of Information
Company understands the importance of securing your information. We are continuously implementing and updating our administrative, technical, and physical security measures to protect your information. For example, we use firewalls to monitor and control our network traffic, encryption to secure our data transmissions, and cryptographic hash functions to store or share certain data.
Please be aware that using the Internet comes with inherent risks. No method of data transmission or method of physical or electronic storage can be guaranteed to be perfectly secure. There is some risk that an unauthorized third party may find a way to circumvent our security or that a transmission of your information over the Internet will be intercepted. Company takes the measures stated above to provide a level of security appropriate to the risks of processing your information. You acknowledge and accept that we cannot guarantee the security of your information.
Aside from our efforts in securing your information, it is your responsibility to protect the security of your account credentials and keep your password confidential. If you notice suspicious activity or believe that your account may have been compromised in some way, please contact us immediately at support@skinresearchinstitute.com.
8. Retention of Information
We may retain your information as required or permitted by applicable laws and regulations. For example, if you are a resident of certain jurisdictions you may be able to request to have your personal information deleted. If your request is granted, we may still be required by medical laws to retain your health information for a period of time. Your medical records will be retained by Company for a period of at least five (5) years, unless a longer period is required by state or federal law, after which they may be destroyed. If you are younger than twenty-three (23) years of age on the date the records may potentially be destroyed, your records will be kept at least until you reach the age of 23 or as required by state or federal law.
9. Your Choices
In order to provide our Services to you, we may send you communications related to your transactions, security, or the administration of this website. Transactional emails are emails we send you relating to your account or in connection with providing you the Services such as emails changing your password, emails in response to your support request, and emails from your medical provider.
From time to time, Company may also send you marketing emails to provide you with free newsletters, surveys, offers, and other promotional materials. If you wish to stop receiving marketing emails from us, you can opt out by clicking the unsubscribe link at the bottom of any marketing email or contact us at support@skinresearchinstitute.com. Please be aware that you cannot opt out of transactional emails. You may opt in to receive text messages. If you decide you no longer wish to receive text messages (including operational, promotional, or transactional) from us, you can opt-out of receiving future text messages by replying “STOP.” However, you acknowledge that opting out of receiving text messages may impact your use of the Services.
You may access your Company account information by going to the “Your Account” page. You can edit your account information as necessary, such as your email address, name, phone number, and more. When you update your account information, we may keep a copy of your previous account details for our records and to prevent fraud or other activities that violate our terms, policies and agreements. However, if you do not provide us with some of your personal information, such as your name or email, we will no longer be able to provide you with access to our Services.

10. California Privacy Rights
California Consumer Privacy Act of 2018 (CCPA)
If you are a California resident you have the following rights subject to certain exceptions:
**The right to know about what personal information in the last 12 months was collected, how it is used, and whether it is disclosed for a business purpose or sold to third parties;
**The right to request deletion of personal information;
**The right to opt-out of the sale of personal information; and
**The right to non-discrimination for the exercise of privacy rights.

Before we approve your request(s), we will ask you to verify certain Personal Information that we have on file. Please note that requests pursuant to the CCPA are limited to non-medical personal information as the CCPA does not apply to health information governed by the CMIA.
Company does not sell your personal information within the normal meaning of the word, but we do use cookies, pixels, and similar technology to improve your user experience. Like many websites, we share certain information, such as your IP address, device ID, click ID, or other similar online identifiers, with certain third-party advertisers in order to optimize our marketing activities and improve your user experience. Under the CCPA’s broad definition of “sell”, this could be considered a sale. If you wish to opt out of this activity, you may do so here. We do not sell the personal information of minors who are at least 13 years old and less than 16 years old, without their opt-in consent.
If you opt-out of the sale of your personal information, we will wait at least 12 months before asking you if we may sell your personal information. You have the right to opt-in to the sale of your personal information after you have opted out. If you would like to opt-in to the sale of your personal information, you can email us at support@skinresearchinstitute.com. Opting-in is a two-step process in which you will first clearly request to opt-in, and then separately confirm that choice.
We will not discriminate against you for exercising your rights under the CCPA.

Privacy Rights for California Minors in the Digital World Act
If you are a California resident under the age of 18 and are a registered user of the Services, then you may request that we remove information you posted on the Services. Please be aware that applicable state or federal law may prevent Company from deleting certain categories of information such as health information. Request for removals should include a description of the specific posted information (including information that will allow us to confirm it was created and posted by you) and should be sent to support@skinresearchinstitute.com.
Do Not Track
Certain web and mobile browsers allow you to send a signal to inform websites that you do not want your online activities tracked. At this time, we do not currently respond to “Do Not Track” signals or similar mechanisms.
11. Updates
We may update this Privacy Notice from time to time and make changes to our information practices as permitted by law. You can reference the date on the bottom to determine when this Privacy Notice was last updated. Any changes will become effective when we post the revised Privacy Notice on the Services. If you are registered for the Services, you will be notified of any material changes to this notice prior to them becoming effective. Telehealth involves the use of electronic communications to enable healthcare providers at different locations to share individual patient medical information for the purpose of improving patient care. Telehealth services offered via Skin Research Institute LLC (“Company”), including any agents, parent companies, providers, subsidiaries, or related entities (collectively, “Company” or “We” or “Us” both capitalized and uncapitalized), may also include chart review, remote prescribing, appointment scheduling, health information sharing, and non-clinical services, such as patient education. The information you provide may be used for diagnosis, therapy, follow-up and/or patient education, and may include any combination of the following: (1) health records and test results; (2) images and asynchronous communications; (3) live two-way audio and video; (4) two-way interactive audio with store and forward; and (5) output data from medical devices and sound and video files. This consent form hereby incorporates by this reference any additional terms and conditions posted by Company through the Website, or otherwise made available to you by Company (“Additional Terms”).
The electronic communication systems we use will incorporate network and software security protocols to protect the confidentiality of patient identification and imaging data and will include measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption.
Our providers, affiliates, and medical professionals (“Providers”) are an addition to, and not a replacement for, your local primary care provider. Responsibility for your overall medical care should remain with your local primary care provider, if you have one, and we strongly encourage you to locate one if you do not.
Expected Benefits. You can expect, but we do not guarantee, some of the following benefits by using telehealth services:
Improved access to care by enabling you to remain in your home while your Provider consults and obtains test results at distant/other sites.
More efficient care evaluation and management.
Obtaining expertise of a specialist as appropriate.
You may contact your Provider for follow-up questions by directly sending a message to your Provider via our member portal. Your Provider will be familiar with and have access to available medical resources in order to make an appropriate referral where medically indicated. Your Provider will typically respond within thirty-six hours.
Service Limitations. There are some limitations inherent to telehealth that you should be aware of, including, but not limited to:
The primary difference between telehealth and direct in-person service delivery is the inability to have direct, physical contact with the patient. Accordingly, some clinical needs may not be appropriate for a telehealth visit and your Provider will make that determination.
OUR PROVIDERS DO NOT ADDRESS MEDICAL EMERGENCIES. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD DIAL 9-1-1 AND/OR GO TO THE NEAREST EMERGENCY ROOM. PLEASE DO NOT ATTEMPT TO CONTACT COMPANY OR ITS AFFILIATES. AFTER RECEIVING EMERGENCY HEALTHCARE TREATMENT, YOU SHOULD VISIT YOUR LOCAL PRIMARY CARE PROVIDER.
Possible Risks. The following are some, but not all, risks associated with using telehealth:
Delays in evaluation and treatment could occur due to deficiencies or failures of the equipment and technologies, or Provider availability.
In rare events, your Provider may determine that the transmitted information is of inadequate quality, thus necessitating a rescheduled telehealth consult or a meeting with your local primary care doctor.
In very rare events, security protocols could fail, causing a breach of privacy of personal medical information.
In very rare events, a lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other judgment errors.
Consent. By checking the box associated with our services, you acknowledge that you understand and agree with the following:
1.I hereby consent to receiving services via telehealth technologies. I understand that Company and its Providers offer telehealth-based medical services, but that these services do not replace the relationship between me and my primary care doctor. I also understand it is up to the Provider to determine whether or not my specific clinical needs are appropriate for a telehealth encounter.
2.I understand a licensed Provider will be assigned to me prior to the consult, however, I can request a different licensed Provider if available. I can review the credentials of my assigned Provider.
3.I understand that federal and state law requires health care providers to protect the privacy and the security of health information. I understand all medical reports resulting from the telehealth visit are part of my medical record.
4.I understand that Company and Provider will take steps to make sure that my health information is not seen by anyone who should not see it. I understand that telehealth may involve electronic communication of my personal medical information to other health practitioners who may be located in other areas, including out of state.
5.I understand there is a risk of technical failures during the telehealth encounter beyond the control of Company and Provider. I AGREE TO HOLD HARMLESS COMPANY AND ITS EMPLOYEES, CONTRACTORS, AGENTS, DIRECTORS, MEMBERS, MANAGERS, SHAREHOLDERS, OFFICERS, REPRESENTATIVES, ASSIGNS, PARENTS, PREDECESSORS, AND SUCCESSORS FOR DELAYS IN EVALUATION OR FOR INFORMATION LOST DUE TO SUCH TECHNICAL FAILURES.
6.I understand that I have the right to withhold or withdraw my consent to the use of telehealth in the course of my care at any time, without affecting my right to future care or treatment. I understand that I may suspend or terminate use of the telehealth services at any time for any reason or for no reason.
7.I understand that if I am experiencing a medical emergency, that I will be directed to dial 9-1-1 immediately and that my Provider not able to connect me directly to any local emergency services.
8.I understand that alternatives to telehealth consultation, such as in-person services are available to me.
9.I understand that I may expect the anticipated benefits from the use of telehealth in my care, but that no results can be guaranteed or assured.
10.I understand that my healthcare information may be shared with other individuals for operational, quality assurance, scheduling, and billing purposes. If I have a real-time consultation, persons may be present during the consultation other than the Provider during such real-time consultation in order to operate the telehealth technologies. I further understand that I will be informed of their presence in the consultation and thus will have the right to request the following: (1) omit specific details of my medical history/examination that are personally sensitive to me; (2) ask non-medical personnel to leave the telehealth examination; and/or (3) terminate the consultation at any time.
11.I understand that I will not be prescribed any narcotics for any reason, nor is there any guarantee that I will be given a prescription at all. I understand that the decision of whether a prescription is appropriate will be made in the professional judgement of my Provider.
12.I understand I can choose to fill my prescription at a pharmacy of my choice.
13.I understand that my Provider reserves the right to deny care for potential misuse of the Services or for any other reason if, in the professional judgment of my Provider, the provision of the Services is not medically or ethically appropriate.
14.I understand that if I participate in a consultation, that I have the right to request a copy of my medical records which will be provided to me at reasonable cost of preparation, shipping, and delivery.
PATIENT CONSENT. I HAVE READ THIS DOCUMENT CAREFULLY AND UNDERSTAND THE RISKS AND BENEFITS OF THE TELEHEALTH CONSULTATION AND HAVE HAD MY QUESTIONS REGARDING THE PROCEDURE EXPLAINED AND I HEREBY GIVE MY INFORMED CONSENT TO PARTICIPATE IN A TELEHEALTH CONSULTATION UNDER THE TERMS DESCRIBED HEREIN.
